These Terms and Conditions govern the use of the SaaS service provided by DeMi Studio s.r.o. (hereinafter referred to as the "Provider") and are binding for all users of this service (hereinafter referred to as the "Tenant").
- Definitions
- "Service" means the software service provided online on a subscription basis.
- "Tenant" means any individual or legal entity that registers an account to use the Service.
- "User" means any individual authorized by the Tenant to use the Service under their account.
- "Subscription" refers to the payment plan based on the number of Users, either monthly or annually.
- Registration and Access to the Service
- To access the Service, the Tenant must create an account and provide valid registration information.
- The Tenant is responsible for securing their account and the data of their Users.
- The Provider reserves the right to refuse or cancel registration if these terms are violated.
- Payments and Billing
- The Service is provided on a monthly or yearly subscription basis, charged based on the number of Users.
- The Tenant agrees to pay the fees outlined in the current pricing plan available on the Provider's website.
- Payments are made using the payment methods supported by the Provider.
- The Provider reserves the right to change the subscription fees. The Tenant will be notified in advance of any price changes.
- Provider's Rights and Responsibilities
- The Provider agrees to provide the Service according to the agreed parameters.
- The Provider reserves the right to temporarily suspend the Service for maintenance or due to technical issues.
- The Provider is not responsible for any losses or damages resulting from improper use of the Service by the Tenant or Users.
- Tenant's Rights and Responsibilities
- The Tenant and its Users must use the Service in accordance with these terms and applicable laws.
- The Tenant may not share their login credentials with third parties.
- The Tenant is responsible for all activities performed under their account.
- Data Protection
- The Provider processes personal data in accordance with applicable data protection laws (e.g., GDPR).
- Detailed information on how the Provider processes personal data is provided in a separate Privacy Policy document.
- Liability
- The Provider shall not be liable for indirect, incidental, or consequential damages caused by the use of the Service.
- Termination of Service
- The Tenant may terminate their subscription at any time through their account.
- The Provider reserves the right to terminate or suspend the Service to the Tenant in case of a breach of these terms.
- Changes to the Terms and Conditions
- The Provider reserves the right to modify these Terms and Conditions at any time. The Tenant will be informed of any changes via email or a notification within the Service.
- By continuing to use the Service after changes have been made, the Tenant agrees to the revised terms.
- Governing Law and Dispute Resolution
- These Terms and Conditions are governed by the laws of the Slovak Republic.
- All disputes arising from or in connection with these terms shall be resolved by the competent courts of the Slovak Republic.
